Checking employee eligibility to work in the UK With the UK Border Agency (the “UKBA”) publishing news of arrests of illegal workers on an almost daily basis, now is as good a time as any to remind yourself of one of your duties as an employer to prevent illegal working The facts As an employer, you have a duty to conduct document checks that employees have the right to work in the UK before they start to work for you. Failure to carry out these pre-employment checks, and be able to demonstrate you have done them, can find you facing penalties currently of up to £10,000 for each illegal worker. There are proposals to increase this to £20,000 per illegal worker from early 2014. It is therefore vital that you ensure your recruitment practices and procedures include this important step by checking the necessary documents. Advice is available on the UKBA website.
